EMFO – Terms and Conditions

Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the Crew and Newcomers Database website (the “Service”) operated by East Midlands Film Office (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Accounts for Crew and Trainees 

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service. By registering on the East Midlands Film Office Crew and Trainees data base, you are confirming: That you have at least 1 year of paid experience within the film and TV industry (NA if you are registering as a Trainee), you are over the age of 18, are eligible to legally work in the UK, and you live within 1 hours drives of your chosen East Midlands County.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

The East Midlands Film office does not accept any responsibility for any jobs you gain through the use of our website. It is the employee’s responsibility to ensure the job being appointed meets your requirements and to check the credentials of any company hiring you.  It is also the responsibility of the employer / production company to check the credentials of any crew hired. The East Midlands Film office is not responsible for checking any credentials of crew and trainees listed on the website. 

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of East Midlands Film Office and its licensors. The Service is protected by copyright, trademark, and other laws of both the UK and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of East Midlands Film Office.

Facilities listings

1. Use of Service 

The Facilities Listing website serves as a platform for listing and finding various facilities available for use or rental. Users are solely responsible for assessing the suitability, legality, and safety of any facility listed on our platform for their intended use.

2. Listing Guidelines

Facility owners or representatives (“Listers”) may list their facilities on our platform subject to our listing guidelines. We reserve the right to remove any listings that violate our guidelines or are deemed inappropriate or fraudulent.

3. Accuracy of information

While we strive to provide accurate information about listed facilities, we cannot guarantee the accuracy, completeness, or availability of any listing. Users are advised to conduct their own due diligence and inspections before finalizing any bookings or transactions.

4. Bookings and Payments 

Users may book facilities listed on our platform subject to availability and agreement between the user and the Lister. Users are responsible for all fees associated with booking a facility, which will be communicated to the user prior to booking. Payment terms will be agreed upon between the user and the Lister.

5. Liability

We shall not be liable for any damages, losses, or liabilities arising from the use of any facility listed on our platform. Users are solely responsible for their use of the facilities and any consequences thereof.

Location Listings

Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the location listing services provided by East Midlands Film Office (the “Agency”, “we”, “us”, or “our”).

By accessing or using the services provided by the Agency, you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the services.

1. Definitions

• “Client” refers to individuals, companies, or organizations seeking film and photography locations through the Agency.
• “Location” refers to properties, venues, or spaces offered for use as film locations by owners or representatives.
• “Service” refers to the services provided by the Agency for connecting Clients with suitable film and photography locations.

2. Use of Service

The Agency acts as a facilitator in connecting Clients with suitable film locations. We do not own or manage the locations listed on our platform. Clients are solely responsible for assessing the suitability and legality of any location for their intended use.

3. Representation of Locations

While we strive to provide accurate information about locations listed on our platform, we cannot guarantee the accuracy, completeness, or availability of any location. Clients are advised to conduct their own due diligence and inspections before finalizing any bookings.

4. Fees and Payments 

The Agency may charge fees for the use of its services, which will be communicated to Clients prior to booking. Clients are responsible for all fees associated with booking a location through the Agency. Payment terms will be agreed upon between the Client and the Agency.

5. Booking and Cancellation 

Booking of locations is subject to availability and agreement between the Client and the owner or representative of the location. Cancellation policies may vary depending on the location and will be communicated to the Client prior to booking.

6. Liability

The Agency shall not be liable for any damages, losses, or liabilities arising from the use of any location booked through our platform. Clients are solely responsible for their use of the locations and any consequences thereof.

7. Intellectual Property

The content and materials provided by the Agency, including but not limited to photographs, descriptions, and listings of locations, are protected by copyright and other intellectual property laws. Clients may not use, reproduce, or distribute such content without the prior written consent of the Agency.

8. Confidentiality

The Agency may collect and process personal information of Clients and location owners in accordance with its Privacy Policy. Client information will be treated confidentially and used only for the purpose of providing the services offered by the Agency.

General Terms and Conditions

Links to other Websites

Our Service may contain links to third-party web sites or services that are not owned or controlled by East Midlands Film Office. 

The East Midlands Film Office has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that East Midlands Film Office shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. 

Governing Law

These Terms shall be governed and construed in accordance with the laws of the UK, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
